SUMMARY OF FUNCTIONS

 

Seeking a Procurement & Contracts Manager who will support a rapidly growing fleet of community solar projects from development to operation. The Commercial & Contracts Manager will ensure that Engineering, Procurement, and Construction (EPC) Contracts are negotiated and agreed in an expedited way while complying with all safety, legal, financial, performance, and quality requirements.

 

This position reports to the SVP of Operations.

 

QUALIFICATIONS:

  • Undergraduate degree in business administration, commerce, engineering, project management, or similar.
  • Basic experience in solar and construction design.
  • Ability to work under hard deadlines and get results from negotiations.
  • Keep a very organized schedule to comply with the overall Annual Operations Plan schedule.
  • Proficiency in Microsoft Word, Excel, PowerPoint and Office.
  • Excellent Communications skills, written and verbal.
  • Outstanding interpersonal skills, including an ability to maintain calm and implement and coordinate effective exchanges by all parties during stressful and unanticipated situations.
  • 10+ years of contract experience preferred.

 

RESPONSIBILITIES

  • Ensures compliance with policies, processes, and standards.
  • Manage Contract reviews and qualifications with third party Engineering, Procurement, and Construction (EPC) Companies.
  • Get Engineering, Procurement, and Construction (EPC) Contracts agreed in a timely fashion while minimizing our contractual risks.
  • Negotiate and agree Limited Notice To Proceed (LNTP) terms and conditions for Engineering scope and Long Lead Equipment, typically consisting of Transformers and Electrical Switchgear with EPC firms.
  • Liaise with Project Management Team daily to understand the timing requirements of the Contract(s) being negotiated plus any conditions required for any of the exhibits such as Prevailing Wage compliance, local community requirements, local permitting, interconnection changes, etc.
  • Interaction with project director/manager to maintain contractual focus and ensure execution of the project according to the contract terms and conditions, to guarantee proper contract oversight, and risk management.
  • Liaise with Vice President of Construction on any deviations to construction technical scopes.
  • Liaise with Sr. Vice President of Engineering on any deviations to engineering technical scopes or to our approved Vendor List.
  • Liaise with the Procurement Manager on any deviations to regular procurement practices.
  • Senior team player with the ability to prioritize key tasks and solve problems.
  • Manage the collection, organization and filing of all EPC Contract documentation, both internally and for external third-party stakeholders and project financing needs.
  • Assist with the development of internal operating policies, standards, and procedures.
  • Look for continuous improvement activities that help standardize the EPC Contract negotiation process and minimize the time it takes to get them signed.
  • Provide high level weekly status on progress of EPC Contracts completion.
